FormWatch
Terms of use
These terms are between you and FormWatch (“we”, “us”), made by Khanh Nguyen in the United States. They cover the FormWatch app and formwatchapp.com. By using FormWatch you agree to them. Our privacy policy explains what happens to your data.
1. Who can use FormWatch
You must be 13 or older. If you are under 18, please use FormWatch only with a parent’s or guardian’s permission. At launch FormWatch is available in the United States only.
2. Your account
You sign in with Apple or with a code sent to your email. You need an account to film or import; the sample session works without one. Please keep access to your email secure, since it signs you in. You can delete your account at any time in Settings › Account › Delete account, which deletes its data on the phone and in the backup.
3. What FormWatch is, and isn’t
- FormWatch gives feedback on your form, read from your own video. It is an estimate made by software, and it can be wrong. Use your judgement, and a coach’s.
- It is not medical or injury advice. Please warm up, play within your limits, and stop if something hurts.
- It doesn’t estimate, predict or certify a rating, and it isn’t connected with any rating system, league or governing body.
- Until a coach’s reference is in the app, the reference rep comes from an interim player who stands in, and the app labels it that way.
4. Your videos and data
Your videos and your data are yours. Your videos stay on your phone. You let us process your body points, scores and settings only to run FormWatch for you: to analyze your sessions, back them up and bring them back on a new phone. Please film only people who are happy to be filmed.
5. Pro and payments
- Your first 3 clips get the full ghost. After that, the skeleton and your score stay free, and the ghost and the dots on every clip come with Pro.
- Pro is a subscription bought through Apple’s App Store. The price is shown in the app before you buy, and Apple charges your Apple account.
- It renews automatically until you cancel. Cancel at least 24 hours before the renewal date in your Apple account settings (Settings › your name › Subscriptions). A free trial, when offered, becomes paid at its end unless you cancel at least 24 hours before.
- Refunds are handled by Apple under its rules. Restore purchases in the app brings Pro back on a new phone.
- Deleting your account doesn’t cancel a subscription. Please cancel it with Apple.
6. Reference content
The reference reps, cues, drills and demo clips in the app are ours or licensed to us, and they’re licensed to you for personal use in FormWatch. Please don’t copy, sell or share them outside the app.
7. Fair use
Please don’t:
- reverse engineer, scrape or overload our backend, or reach it other than through the app;
- use another person’s account, or make accounts automatically;
- use FormWatch to film people without their agreement, or for anything unlawful.
We may suspend or close an account that breaks these rules. We’ll tell you why when we can.
8. Changes to FormWatch and to these terms
We’ll keep improving FormWatch, which means features may change. If we ever stop the service, we’ll tell you ahead of time and you’ll be able to export your data. If we change these terms we’ll post them here with a new date, and tell you in the app or by email if the change matters.
9. Disclaimers and liability
FormWatch is provided as it is and as available. As far as the law allows, we make no promise that it will be free of errors or always available, and we aren’t liable for indirect or consequential losses. As far as the law allows, our total liability to you is limited to the amount you paid us in the 12 months before the claim. Some places don’t allow these limits, so they may not apply to you. Nothing here limits rights you have by law.
10. Governing law
These terms are governed by the laws of the State of [to be confirmed], United States. If we disagree, please write to us first; most things can be settled by email.
11. Apple
These terms are between you and us, not Apple. Apple isn’t responsible for FormWatch or its content, has no obligation to provide support for it, and isn’t responsible for any claims about it. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them. Your use of the App Store is also covered by Apple’s own terms.
